Our Constitution

The Constitution of the Republic of Enstrania

The Supreme Law of the Land \\u2014 Established 2024

Preamble

\”We, the People of the Republic of Enstrania, in order to form a more perfect union, establish justice, ensure domestic tranquility, and secure the blessings of liberty to ourselves and our posterity, do ordain and establish this Constitution for the Republic of Enstrania.\”

Articles of the Constitution

Article I \\u2013 The Legislative Branch — Establishes the National Assembly, its composition, powers, and procedures for enacting laws.
Article II \\u2013 The Executive Branch — Defines the office of the President, the Council of Ministers, and the execution of national policy and law.
Article III \\u2013 The Judicial Branch — Constitutes the courts of the Republic and safeguards the independence of the judiciary.
Article IV \\u2013 Rights and Freedoms of Citizens — Enumerates and protects the fundamental rights, liberties, and duties of all citizens of Enstrania.
Article V \\u2013 Amendments and Revisions — Sets forth the procedures for proposing, deliberating, and adopting amendments to this Constitution.
Article VI \\u2013 National Sovereignty and Territory — Affirms the sovereignty, territorial integrity, and constitutional symbols of the Republic.
Article VII \\u2013 Ratification and Supremacy — Provides for the ratification of this Constitution and its supreme authority over all laws and acts.

Fundamental Rights of Citizens

The Constitution solemnly guarantees the following fundamental rights to every citizen of the Republic of Enstrania, subject only to such limitations as are prescribed by law, are necessary in a democratic society, and are consistent with the spirit of this Constitution:

Freedom of Speech — The right to express opinions and ideas without unwarranted interference, subject to constitutional limitations.
Right to Equal Protection — Equal protection of the laws without discrimination on any ground recognized by this Constitution.
Right to Fair Trial — A fair, public, and impartial hearing within a reasonable time by an independent and competent court.
Freedom of Religion — The freedom to profess, practice, and change one’s religion or belief, individually or in community with others.
Right to Privacy — Protection against arbitrary or unlawful interference with one’s privacy, family, home, or correspondence.
Freedom of Assembly — The right to peaceful assembly and association for lawful purposes.

Constitutional Amendments

The Constitution of the Republic of Enstrania is designed to endure and to respond to the evolving needs of the People. Amendments may be proposed by a qualified majority of the National Assembly or, in such manner as the law may provide, by a popular initiative supported by a prescribed number of citizens.

Every proposed amendment shall be subjected to transparent public deliberation and debate. To enter into force, an amendment must be adopted by a supermajority of the National Assembly and, where so required by this Constitution, approved by the People in a national referendum conducted in a free, fair, and orderly manner.

No amendment may abrogate the republican form of government, the sovereignty of the People, or the core guarantees of human dignity, fundamental rights, and the independence of the judiciary, which are hereby declared to be unalterable principles of the constitutional order.
